  1. What do I agree to by entering the Blog?

    You are invited to use blog.brasher.co.uk (the "Blog") on the basis of the terms and conditions of use set out below.

    By entering the Blog and using its Features (as defined below) you are deemed to have read and accepted these Terms and Conditions. You, and any other person, are deemed a user (a "User") of the Blog by registering with the Blog (a "Member") or by gaining access to or browsing the Blog intentionally or otherwise (a "Visitor"). If you do not accept these Terms and Conditions or any part of them, you should not enter or use the Blog.

    Brasher may modify or update these Terms and Conditions from time to time. If you continue to use this Blog after any changes, this means you agree to be bound by the modified Terms and Conditions.

    If we do make a change to the Terms and Conditions we will post it at the top of this page, together with the date of the change, so you can easily find it.
     
  2. The Features

    The features of this Blog may include website services, bulletin and message boards and any other features, content or applications offered from time to time by Brasher (known collectively as the "Features").
     
  3. Conditions of Using Features on the Blog

    You agree to use the Features in this Blog in good faith and in the spirit in which they are made available to you. In particular you agree:

    (a) not to submit any Content (as defined in clause 5 below) which is obscene or vulgar, offensive, abusive, harmful, threatening, libellous, defamatory, invasive of anotherís privacy, racially or ethically or religiously insulting or otherwise unlawful;

    (b) not to use Features on the Blog for any purpose that is illegal or which is or may be damaging to the rights or interests of Brasher or any User or other party;

    (c) if you or any other party has any issues or concerns with the content of any communications generated via the Blog, you should contact the Blog moderator as soon as possible at help@brasher.co.uk;

    (d) that the Blog and all Features will be used entirely at your own risk and Brasher accepts no responsibility for any losses or consequences suffered by you as a result of your use of the Blog and any Features; and

    (e) that you are solely responsible for your interactions with other Users and Brasher reserves the right to monitor disputes between Users but is under no obligation whatsoever to do so.

    If Brasher is informed or has any reason to believe that the Blog or any of the Features on our Blog are being used by a User other than in accordance with these Terms and Conditions, Brasher reserves the right to suspend or permanently prevent access by the User to the Blog and the Features and Brasher shall have no liability to the User whatsoever in such event.
     
  4. Content Posted on the Blog

    (a) You must not submit to the Blog any telephone numbers, street addresses, last names or other personal information belonging to a third party without their consent.

    (b)You must not submit to the Blog any photographs or images containing nudity, or obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable subject matter.

    (c) Brasher may at its sole discretion without explanation delete or modify any Content (as defined in clause 5 below) you submit to the Blog that Brasher deems violates these Terms and Conditions or that Brasher deems inappropriate.

    (d) Brasher reserves the right to monitor and modify any Content, and remove any inappropriate Content.  Brasher accepts no such responsibility for the conduct of the Blogís Users.

    (e) All Users are solely responsible for the Content they submit to the Blog.

    (f) All Content submitted by Users is reviewed by Brasher before being posted on the Blog, however the views posted on the Blog do not necessarily reflect the opinions of Brasher.

    (g) Brasher reserves the right at its sole discretion without explanation or notice, to remove, modify, reject or refuse to post any Content submitted by you, or may suspend or restrict access or terminate any Userís access to any or all parts of the Blog without liability.
     
  5. Ownership Rights in Content

    We are happy for you to submit to the Blog any texts, information, ideas, suggestions, graphics, data, pictures, video, sounds, or anything else (known collectively as the "Content"), but do please remember that, by sending us such material, you grant to Brasher (and any of its subsidiaries or associated companies) a perpetual, non-exclusive, global, royalty free licence to use, modify, publicly perform or display, reproduce and distribute such Content on the Blog and on any other medium which Brasher decides. That means that all stories, comments, suggestions, ideas, graphics or other information sent to us can be used as Brasher deems fit. This includes using it for promotional, marketing or any other commercial purpose, whether in advertising, or in developing, manufacturing or marketing products. Under no circumstances are you entitled to any payment if we do use your Content for any purpose.

    So remember donít submit to the Blog any material if you donít want us to use it or the world to know it, and donít submit to the Blog any material unless you have the full right and legal entitlement to do so.

    This Blog is intended to provide amongst other things, information relating to Brasher products.

    All trade marks appearing on the Blog are owned by The Brasher Boot Company Limited and nothing contained in this Blog shall be construed as conferring by implication or otherwise any licence or right to use any of the Intellectual Property Rights displayed or subsisting on or in this Blog other than in accordance with these Terms and Conditions or unless previously authorised or licensed by Brasher.
     
  9. Limitation of Liability

    The Internet is by its nature an unreliable medium. Consequently, you accept that this Blog is offered on an "as is" and "as available" basis.

    While Brasher takes all reasonable steps to ensure that the Blog is properly functioning at all times, Brasher does not warrant that this Blog will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that this Blog or the server that makes it available are free of software viruses or bugs or other defects.

    Brasher has no control over, and expressly disclaims all responsibility for, any Content you encounter, or events which may occur as a result of your use of the Blog or the Features and Brasher shall not be liable for any direct, indirect or consequential loss, damage, harm, cost or expense of any type whatsoever incurred by you as a result of your use of the Blog or the Features, or the Content.

  10. Governing Law

    These Terms and Conditions and your use of this Blog shall be governed by and construed in accordance with English Law.

    By accepting these Terms and Conditions and using the Blog, you accept that any dispute under these Terms and Conditions or arising out of use of this Blog shall be subject to the exclusive jurisdiction of the English courts and by using this Blog you hereby submit to the jurisdiction of such courts for such purposes and waive any and all objections to jurisdiction or venue in such courts.

    If you are accessing this Website from any other jurisdictions (apart from England and Wales) you agree to be responsible for compliance with local laws, to the extent any local laws are applicable.
